Terms of Use

1. Acceptance

By creating an account, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. The Service

DinkFox is a software platform that helps pickleball players and hosts coordinate pickup and recurring play. Depending on your account and settings, the Service may include:

• Accounts and profiles — sign-up, authentication, public handle, skill and optional rating fields, location-related fields used for matching and discovery, avatars, and preferences.
• Games — creating and joining games, rosters and waitlists, approvals, visibility and access rules, and related coordination.
• Court coverage and booking details — recording which players booked which courts or time windows so groups can align headcount with capacity (the Service does not replace club reservation systems unless a venue or integration explicitly provides that).
• Venues — creating, editing, favoriting, reviewing, reporting issues with, and discovering venue records that users contribute, including addresses, court layout images, photos, and related metadata used for games and maps.
• Discovery and search — browsing and filtering games by level, format, time, location, and other criteria you or organizers provide.
• Groups, chat, and polls — recurring crews, member invitations and permissions, threaded discussions, polls, galleries, photos, and member lists where those features are enabled.
• Notifications and announcements — in-app and email-style alerts you configure or that we send for operational or safety reasons, plus optional product announcements where permitted.
• Local play and venue activity — tools that surface recent activity or busyness signals based on user-generated data, not a guarantee of real-time court availability at any facility.
• Fast or streamlined game creation — shortcuts that reuse saved preferences or venues when we offer them.
• Analytics and recommendations — dashboards, player or group insights, ranking signals, and suggested games or actions based on activity in the Service.

Features may change, be renamed, added, or retired. We may offer beta or experimental functionality without warranty. DinkFox is not a court reservation marketplace, a tournament operator, or a substitute for facility rules, contracts, or insurance.

3. Eligibility

You must be old enough to form a binding contract in your jurisdiction and meet any minimum age we specify in the sign-up flow. The Service is not directed to children under 13. If you are between 13 and the age of majority where you live, you may use the Service only with the involvement of a parent or guardian as required by applicable law.

4. Accounts and security

You are responsible for safeguarding your login credentials and for all activity under your account. You agree to provide accurate information and to update it when it changes. Notify us promptly if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms, create risk, or must be restricted for legal or operational reasons.

5. User content and license

You retain ownership of content you submit ("User Content"). You grant DinkFox a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify, display, and distribute User Content solely to operate, improve, secure, and promote the Service and as described in our Privacy Policy. You represent that you have the rights needed to grant this license and that your User Content does not violate third-party rights or applicable law. User Content may include profile photos, group banners, group gallery photos, chat attachments, venue photos, court layout images, reviews, reports, poll responses, scores, and similar materials you submit.

6. Acceptable use

You agree not to misuse the Service. For example, you must not:

• Harass, threaten, defraud, or endanger other people;
• Post unlawful, infringing, hateful, or sexually exploitative content;
• Impersonate another person or misrepresent your affiliation or skill level in a deceptive way;
• Scrape, crawl, harvest, or bulk-collect data from the Service without our written permission;
• Probe, scan, or test the vulnerability of the Service, or circumvent access or rate limits;
• Upload malware, overload infrastructure, or interfere with other users' access;
• Use the Service to send unsolicited commercial messages outside features intended for that purpose.

We may investigate reports, remove content, restrict features, or involve law enforcement where appropriate.

7. Organizers, players, and third parties

Hosts and organizers are independent from DinkFox. We do not employ players, control facilities, or guarantee that any game will occur as posted. Venues, homeowners associations, cities, reservation systems, and insurers may impose their own rules. You are responsible for complying with those rules and with all applicable laws when you play or organize.

8. Courts, reservations, and physical access

Information shown in the Service about courts, bookings, wait times, or venue activity is based on user contributions and system logic—not a promise of real-time accuracy. DinkFox does not guarantee court availability, line fairness, or access to any physical location. You remain responsible for official reservations, fees, waivers, and facility policies.

9. Third-party services

The Service may allow you to sign in or link with third-party identity or data providers (for example OAuth), open maps or directions, receive email delivery, or install mobile apps through app stores. Those providers' terms and privacy policies apply to what you share with them.DinkFox is not responsible for third-party sites, app stores, maps, venues, reservation systems, or services linked from the Service.

10. Intellectual property

DinkFox and its branding, logos, and software are owned by us or our licensors. Except for the limited rights granted in these Terms, no rights are transferred to you. Do not copy, modify, or reverse engineer the Service except where applicable law expressly allows.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Pickleball and related activities involve inherent physical risk; you participate voluntarily and at your own risk.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DinkFox AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100), IF YOU HAVE NOT PAID US. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

13. Indemnity

You will defend, indemnify, and hold harmless DinkFoxand its operators, affiliates, contractors, and personnel from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your User Content, your use of the Service, or your violation of these Terms or applicable law.

14. Changes

We may modify the Service or these Terms from time to time. If we make material changes, we will provide notice as required by law—such as posting an updated version, sending an email, or showing an in-app notice. Your continued use after the effective date of changes constitutes acceptance unless applicable law requires otherwise.

15. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, if we must comply with law, or if we discontinue the Service or your account in whole or in part. Provisions that by their nature should survive (including licenses to the extent needed to wind down, disclaimers, limitations, indemnity, and dispute terms) will survive termination.

16. General

These Terms constitute the entire agreement between you and DinkFox regarding the Service and supersede prior understandings on the same subject. If a provision is unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. Unless applicable law says otherwise, there are no third-party beneficiaries to these Terms.
